Geachte Collega’s,
Met enige verwondering heb ik de rapportage van Ernst &Young gelezen inzake het “Rechtmatigheidsonderzoek 2008” van aanbestedingsdossiers van 1 april tot 1 oktober 2008.
Het lijkt er op dat ons DB noch een aantal gunnende ambtenaren de lessen van het dossier 4e Bergboezem begrepen hebben of willen begrijpen.
Met het mandateren aan de sectorhoofden om tot een bedrag van € 150.000 afwijkende besluiten te nemen, legt het DB besluiten over afwijkende gunningen weer in handen van één persoon (het sectorhoofd). Dat is nu precies wat fout is gegaan in het verleden waar projectleiders veelvuldig gunningen uit de hand verrichtten (voor hun project) aan één enkele partij. Nu kan dat weer gebeuren met niet middels de dossiers controleerbare motieven, zoals als: ‘er is slechts één leverancier’. Waren er geen alternatieve producten, met meerdere leveranciers? Is de af te nemen dienst of product patentrechtelijk beschermd of door een vergunningverlenende instantie voorgeschreven?
In een ander geval claimt de betreffende projectleider dat de doorlooptijd ‘bij deze leverancier korter zou zijn dan bij andere leveranciers’. Was dat dan absoluut nodig? Is dat met offertes of mails onderbouwd? Was dat een selectievoorwaarde?
In weer een ander geval was er sprake van een motivatie gelegen in een tijdelijke overbrugging van een periode tot een Europese aanbesteding (geen autorisatie). Weer op informatie van de projectleider. Weer geen stukken die het onderbouwen.
Het lijkt er op dat, om het verhaal werkelijk tussen de oren te krijgen, er drastischer maatregelen nodig zijn, zoals het intrekken van een mandaat dat de kat op het spek bindt. Wanneer is dit mandaatbesluit genomen en wat waren de motieven van het DB in deze? Van wie is dit voorstel tot mandatering gekomen?
Feitelijk zijn dit soort afwijkingen alleen rechtmatig gemaakt door de mandatering. Het lijkt er op dat het DB of de ambtelijke leiding zich liever niet bemoeit met aanbestedings/gunningsbesluiten. Het wordt tijd dat dit veranderd. Mijn verzoek is het bovenstaande te betrekken in uw fractieberaden, zodat er eventueel een AB brede motie kan worden ingediend om dit mandaatbesluit in te trekken.
